Qualifying home sales
Rockville’s current public information says that laws put into effect in 2023 apply Montgomery County’s home-energy disclosure and radon-testing laws to the sale of single-family homes and townhomes in Rockville.
The City’s public materials describe a seller providing the buyer with results of a radon test conducted less than one year before the sale date for qualifying single-family homes or townhomes. The City and County sources describe exclusions that should be checked before relying on a summary.
Qualifying rentals
Rockville’s rental testing requirement became effective September 27, 2023. It covers units in rental facilities that are in contact with the ground, including basement apartments and dwelling units with a basement, crawlspace, or slab in contact with the ground.
The City says a landlord must test before leasing a qualifying dwelling unit. Its published guidance describes tenant notice after a result at or above the action level, landlord follow-up testing within 14 days, mitigation after confirmation, delivery of final results, and lease-termination rights if the issue is not mitigated.
